Terms of Service

1. Eligibility

You must be at least 18 years old to create an account and place orders on the Platform. By using the Platform, you represent that you meet this requirement. Users under 18 may use the Platform only under parental or guardian supervision.

2. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and current information during registration.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@aerosmashadminton.pk if you suspect unauthorised use of your account.
• AeroSmash reserves the right to suspend or terminate accounts that violate these Terms.

3. Buyer Conduct

As a buyer on the Platform, you agree to:

• Provide accurate delivery information for each order.
• Pay for all orders you confirm, including COD orders you accept upon delivery.
• Not engage in fraudulent returns, chargebacks or abuse of the dispute process.
• Not purchase products for the purpose of resale as counterfeit or misrepresented goods.
• Leave honest and accurate product reviews based on genuine experience.

4. Seller Conduct

Sellers on the Platform agree to:

• List only genuine, accurately described products.
• Maintain sufficient stock for listed items or promptly mark them out of stock.
• Dispatch orders within the processing time displayed on their store.
• Not list counterfeit, stolen or prohibited items.
• Honour the AeroSmash return and refund policy as the minimum standard.
• Comply with all applicable laws and regulations in Pakistan.

Violation of seller terms may result in listing removal, account suspension, and withholding of payouts pending investigation.

5. Pricing and Payments

• All prices on the Platform are in Pakistani Rupees (PKR) and include applicable sales tax.
• AeroSmash reserves the right to correct pricing errors; affected orders will be cancelled with a full refund.
• Payment is collected at the time of order placement (prepaid methods) or upon delivery (COD).
• AeroSmash is not liable for failed payment transactions caused by your bank, mobile wallet provider or internet connectivity.

6. Intellectual Property

All content on the Platform including logos, images, text, product descriptions, software and design is owned by AeroSmash or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute or create derivative works without our express written permission. Sellers retain ownership of their product images and descriptions but grant AeroSmash a non-exclusive licence to display and use them on the Platform.

7. User-Generated Content

By submitting reviews, Q&A responses, photos or other content to the Platform, you grant AeroSmash a non-exclusive, royalty-free, perpetual licence to use, display and modify that content for promotional and operational purposes. You are responsible for ensuring your content does not infringe the rights of any third party.

8. Prohibited Activities

You may not use the Platform to:

• Violate any applicable law or regulation
• Transmit spam, malware or phishing content
• Scrape, crawl or data-mine the Platform without permission
• Manipulate reviews or ratings (including incentivised or fake reviews)
• Impersonate another user, seller or AeroSmash staff
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure

9. Limitation of Liability

AeroSmash acts as a marketplace connecting buyers and sellers. We are not the seller of record for third-party seller listings. To the maximum extent permitted by law, AeroSmash shall not be liable for:

• Loss of profits, revenue or data arising from use of the Platform
• Defects in products sold by third-party sellers (claims must be raised with the seller)
• Delays by courier partners outside our reasonable control
• Service interruptions due to maintenance or technical failures

Our maximum liability to any user shall not exceed the amount paid by that user for the specific transaction giving rise to the claim.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.
